Certificates of Correction
If a property present a violation of a part of the New York City Construction Codes and/or Zoning Resolution, then a Environmental Control Board (ECB) violation can be issued by the Department of Buildings.
It exists three different types of violation: Class 1 (Immediately Hazardous), Class 2 (Major) and Class 3 (Lesser).
A Class 1 violation should be immediately corrected and certified. Failure to certify it can result in the issuance of a DOB violation with a $1,500 civil penalty. Moreover, uncorrected violations may lead to additional violations.
Concerning a Class 2 or 3 violation, a certificate of violation should be issued to the DOB in 40 days.
To certify a correction, the current documents should be sent to the DOB: an original Certificate of Correction, a proof of correction and a notarized statement attesting to how the violation was corrected.
